The institute shall not be liable to the student or any third party for any such modification or discontinuation.

The student shall be responsible for providing accurate and complete information when registering for courses or programs. The institute reserves the right to deny access to its services or to any course or program based on the student's qualifications or suitability for the course or program. The student shall have access to the institute's services for the duration of their enrollment in a course or program. The institute shall use reasonable efforts to provide quality services to the student, but makes no warranties or guarantees as to the quality or effectiveness of the services provided. The institute shall not be liable to the student or any third party for any direct or indirect damages or losses resulting from the student's use of the services provided.

The institute shall comply with all applicable privacy laws and regulations in its use of the student's personal information. As per Regulation 3(2) of the IG Rules, TRRev Technology informs Users that they are strictly prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, updating, or sharing any content that:

  • Belongs to another person and over which the User has no rights.
  • Is harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, racially or ethnically objectionable, disparaging, related to or encouraging money laundering or gambling, or otherwise unlawful.
  • Harms minors in any way.
  • Infringes on any patent, trademark, copyright, or other proprietary rights.
  • Violates any applicable laws.
  • Deceives or misleads the recipient about the origin of such messages or is grossly offensive or menacing in nature.
  • Impersonates another person.
  • Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer resource.
  • Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order, or incites the commission of any cognizable offense, obstructs investigation of any offense, or insults any other nation.

Users are also prohibited from:

  • Violating or attempting to violate the integrity or security of the Website or any TRRev Technology content.
  • Transmitting any information (including job posts, messages, and hyperlinks) on or through the Website that is disruptive or competitive to the Services provided by TRRev Technology.
  • Intentionally submitting any incomplete, false, or inaccurate information on the Website.
  • Making unsolicited communications to other Users.
  • Using any engine, software, tool, agent, or other device or mechanism (such as spiders, robots, avatars, or intelligent agents) to navigate or search the Website.
  • Attempting to decipher, decompile, disassemble, or reverse engineer any part of the Website.
  • Copying or duplicating in any manner any of the TRRev Technology content or other information available from the Website.
  • Framing, hot linking, or deep linking any TRRev Technology content.
  • Circumventing or disabling any digital rights management, usage rules, or other security features of the Software.

TRRev Technology, upon obtaining knowledge or being informed by an affected person in writing or via email signed with an electronic signature about any such prohibited content as mentioned above, shall be entitled to disable such content that violates above Clauses. TRRev Technology will also preserve such content and associated records for at least 90 days for potential production to governmental authorities for investigation purposes.

In case of non-compliance with any applicable laws, rules or regulations, or the Agreement (including the Privacy Policy) by a User, TRRev Technology has the right to immediately terminate the access or usage rights of the User to the Website and Services and to remove non-compliant information from the Website.

TRRev Technology may disclose or transfer User-generated information to its affiliates or governmental authorities in such manner as permitted or required by applicable law, and you hereby consent to such transfer. The SPI Rules only permit TRRev Technology to transfer sensitive personal data or information including any information, to any other body corporate or a person in India, or located in any other country, that ensures the same level of data protection that is adhered to by TRRev Technology as provided for under the SPI Rules, only if such transfer is necessary for the performance of the lawful contract between TRRev Technology or any person on its behalf and the User or where the User has consented to data transfer.

TRRev Technology respects the intellectual property rights of others and we do not hold any responsibility for any violations of any intellectual property rights

Procedure for Reporting Claimed Infringement

Notification of Claimed Infringement

If you believe that any content made available on or through JustAcademy infringes an intellectual property right you own or control, please promptly send a "Notification of Claimed Infringement" containing the following information to JustAcademy's Email address (info@justacademy.co). Your communication must include the following:

  • Authorized Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of the work(s) that have allegedly been infringed.

  • Identification of Infringed Works: Identification of works or materials being infringed, or a representative list of such works if multiple works are covered by a single notification.

  • Identification of Infringing Material: Identification of the specific material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to permit JustAcademy to locate the material.

  • Contact Information: Information reasonably sufficient to permit JustAcademy to contact you, such as an address, telephone number, and, if available, an electronic mail address.

  • Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  • Accuracy and Authorization Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Termination

TRRev Technology reserves the right to suspend or terminate a User’s access to the Website and the Services with or without notice and to exercise any other remedy available under law, in cases where,

  • Such User breaches any terms and conditions of the Agreement
  • A third party reports violation of any of its right as a result of your use of the Services
  • TRRev Technology is unable to verify or authenticate any information provide to TRRev Technology by a User
  • TRRev Technology has reasonable grounds for suspecting any illegal, fraudulent or abusive activity on part of such User
  • TRRev Technology believes in its sole discretion that User’s actions may cause legal liability for such User, other Users or for TRRev Technology or are contrary to the interests of the Website.

Once temporarily suspended, indefinitely suspended or terminated, the User may not continue to use the Website under the same account, a different account or re-register under a new account. On termination of an account due to the reasons mentioned herein, such User shall no longer have access to data, messages, files and other material kept on the Website by such User. The User shall ensure that he/she/it has continuous backup of any medical services the User has rendered in order to comply with the User’s record keeping process and practices.

Limitation of Liability

In no event, including but not limited to negligence, shall TRRev Technology, or any of its directors, officers, employees, agents or content or service providers (collectively, the “Protected Entities”) be liable for any direct, indirect, special, incidental, consequential, exemplary or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use, the Website or the content, materials and functions related thereto, the Services, User’s provision of information via the Website, lost business or lost End-Users, even if such Protected Entity has been advised of the possibility of such damages. In no event shall the Protected Entities be liable for:

  • Provision of or failure to provide all or any service by Practitioners to End
  • Users contacted or managed through the Website
  • any content posted, transmitted, exchanged or received by or on behalf of any User or other person on or through the Website
  • any unauthorized access to or alteration of your transmissions or data; or
  • any other matter relating to the Website or the Service.

In no event shall the total aggregate liability of the Protected Entities to a User for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from this Agreement or a User’s use of the Website or the Services exceed, in the aggregate Rs. 500/- (Rupees Five Hundreds Only).

Retention And Removal

TRRev Technology may retain such information collected from Users from its Website or Services for as long as necessary, depending on the type of information; purpose, means and modes of usage of such information; and according to the SPI Rules. Computer web server logs may be preserved as long as administratively necessary.

Applicable Law And Dispute Settlement

  • You agree that this Agreement and any contractual obligation between TRRev Technology and User will be governed by the laws of India.
  • Any dispute, claim or controversy arising out of or relating to this Agreement, including the determination of the scope or applicability of this Agreement to arbitrate, or your use of the Website or the Services or information to which it gives access, shall be determined by arbitration in India, before a sole arbitrator appointed by TRRev Technology. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Thane. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties to the dispute.
  • Subject to the above Clause, the courts at Thane shall have exclusive jurisdiction over any disputes arising out of or in relation to this Agreement, your use of the Website or the Services or the information to which it gives access

Refund / Swap / Batch-shift Policy for JustAcademy

Refund Policy for Instructor-Led Live Sessions

  • We offer users a seven (7)-day refund period from the date of purchase.
  • The refund must be requested within 7 days of purchase. The money-back guarantee is void if the learner has accessed more than 2 classes or downloaded any JustAcademy course material.
  • No refund requests will be accepted beyond 7 days from the date of purchase.
  • All programs offered jointly by universities, colleges, Tech Masters, or as part of internship courses are non-refundable.
  • Course cancellations and termination of EMIs are not permitted after 7 days from enrollment.

Refund Policy for Voucher-Related Courses (PMP, CEH, CompTIA, ITIL, Prince2, etc.)

  • Refund requests must be made within 7 days of registration. The money-back guarantee is void if the learner fails to request a refund within 7 days from the date of purchase. After the voucher purchase, refund requests are invalid under all circumstances.

Refund Policy for PG / PC Programs (JustAcademy and University/College Joint Collaboration)

  • The refund policy terms and conditions mentioned here do not apply to PG programs.
  • All PG / PC programs are non-refundable after enrollment.

Scenarios Nullifying the Money-Back Guarantee

  • If any course content is downloaded from JustAcademy's learning management system.
  • If more than 2 class recordings are viewed from JustAcademy's learning management system.
  • If the learner has attended 2 or more live sessions.

Abuse of Refund Policy

  • If we believe you are abusing our refund policy, we reserve the sole discretion to suspend or terminate your account and refuse or restrict any and all current or future use of JustAcademy products, without any liability to you.

Revision of Terms

  • JustAcademy reserves the absolute right to revise these terms without prior notice, other than by posting revised terms on the website.
  • JustAcademy reserves the right to postpone or cancel an event due to insufficient enrollments, instructor emergency, or natural disasters (like floods, earthquakes, political instability, etc.).

Duplicate Payment Refunds

  • Refunds for duplicate payments made by the learner will be processed to the same source (original method of payment) within 7 business days after notification by the learner.

Requesting a Refund

  • To request a refund, please raise a ticket using your registered email ID only.

Processing Refund Requests

  • All refund requests will be processed within 7 working days from the date of approval by JustAcademy.

Batch-Shift Quota

  • Limited seats (batch-shift quota) are available in any live-online class for learners availing the batch-shift option. JustAcademy may not accommodate certain batch-shift requests due to unavailability of seats. In such cases, JustAcademy will provide options to join other batches where seats are available.


Batch-Shift Frequency

  • Learners can avail of the batch-shift option ONLY once every 3 months from the start of the previous batch attended.

Batch-Shift Availability

  • The batch-shift option will be available only after 15 days from the start of the previous batch.

Batch-Shift for PG / PC Programs

  • The batch-shift option is not applicable for PG / PC programs (JustAcademy and University/College joint collaboration).

Severability

If any provision of the Agreement is held by a court of competent jurisdiction or arbitral tribunal to be unenforceable under applicable law, then such provision shall be excluded from this Agreement and the remainder of the Agreement shall be interpreted as if such provision were so excluded and shall be enforceable in accordance with its terms; provided however that, in such event, the Agreement shall be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction or arbitral tribunal.

Waiver

No provision of this Agreement shall be deemed to be waived and no breach excused, unless such waiver or consent shall be in writing and signed by TRRev Technology. Any consent by TRRev Technology to, or a waiver by TRRev Technology of any breach by you, whether expressed or implied, shall not constitute consent to, waiver of, or excuse for any other different or subsequent breach.
